Waiver Required

In consideration of the permission to engage in farm-related activities at Serenity Rock Farms, located at 547 Bull Mill Rd in Chester, NY, I hereby acknowledge and agree as follows:

1. Acknowledgement of Risks. I understand that agricultural tourism activities involve inherent risks, including but not limited to:
 

•       Interaction with animals

•       Exposure to farm equipment

•       Uneven terrain

•       Outdoor environmental conditions such as weather

•       Possible allergic reactions to plants, animals, insects, or products found on the farm

•       The propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability. 
 

I acknowledge that these activities may cause injury, death, property damage, or other harm. Despite these risks, I voluntarily choose to participate—or to allow the minor listed below to participate—in these activities.
 

2. Assumption of Risk. I, the undersigned, voluntarily assume all risks, both known and unknown, associated with my participation—or the participation of the minor for whom I am legally responsible—in agricultural tourism activities at Serenity Rock Farms.

3. Release of Liability. In exchange for participation in these activities, I, on behalf of myself (or the minor named below), my (or the minor’s) heirs, assigns, personal representatives, and estate, hereby release, discharge, and hold harmless Serenity Rock Farms, its owners, officers, employees, volunteers, and agents from any and all claims, liabilities, actions, or causes of action arising out of or related to participation in agricultural tourism activities.

This release includes any claim for injury, illness, death, or property damage, whether caused by negligence (if allowed by laws of this State), breach of contract, or any other reason.

4. Compliance with New York State Law. I acknowledge that New York State law (the “Safety in Agricultural Tourism Act”) requires Serenity Rock Farms to provide written disclosures of the inherent risks of agricultural tourism activities. By signing this waiver, I affirm that I have read and understood the warnings and disclosures provided.

5. Medical Consent. In the event of an emergency, I give permission to Serenity Rock Farms to administer first aid or to arrange for medical treatment, including contacting emergency services if necessary, for myself or for the minor named below. I understand that I will be responsible for any costs incurred for such treatment.

6. Photographic Consent. I grant permission for Serenity Rock Farms to take photographs or videos during our visit for promotional or educational purposes. I understand that no compensation will be provided for the use of such images.

7. Severability. If any portion of this waiver is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS BY SIGNING IT, INCLUDING THE RIGHT TO SUE. I SIGN IT VOLUNTARILY AND WITHOUT ANY INDUCEMENT.
